Furniture Terms and Conditions
1. Proposal Acceptance.The client indicates his acceptance of the proposal by paying a 30% First Instalment (ref. Section 2 below). By payment of this First Instalment, the client
a. acknowledges that he has checked and approved the furnishings and prices itemized in the proposal.
B. agrees that he has read and accepted these Terms and Conditions of Purchase.
2. Payment Terms and Conditions.
a. A 30% First Instalment confirms acceptance of the proposal and secures the proposal price for 12 months.
b. At least 6 weeks prior to delivery, a second instalment equal to 50% of the order value is due. On receipt of this payment, pso ltd will begin ordering project materials. Any delay in this payment may result in delay of delivery.
c. Final balance is due either on or before the date of delivery. (If the client or client´s representative is not available to pay in person at the time of delivery, then the balance must be paid in advance or before 2pm on the day of delivery.) Furniture will not be delivered until the project balance has been received.
3. Method of Payment.
Payments can be made by
a. Bank transfer in Stirling (any fees associated with the transfer are to be paid by the client). When paying the final balance, the transferred funds must reach pso's account at least 48 hours ahead of the scheduled delivery.
b. English cheque. When paying the final balance by cheque, pso must receive the cheque at least 5 days prior to delivery, in order that the cheque may have time to clear.
c. Major credit cards can be accepted either in person, by fax, email or over the phone.
d. Cash payment in GBP.
4. Delivery Terms and Conditions.
An estimated delivery date will be agreed on proposal acceptance. As this estimated date approaches, pso will request confirmation from the client that the property is ready to receive delivery. Upon confirmation, a specific delivery date will be reserved.
a. Clients must request the installation date at least 6 weeks prior to the desired date. Delivery reservations will be granted on a first come, first served basis.
b. The client is responsible for ensuring that keys are available, either by providing a key to PSO or by arranging a key holder to permit entry on the day of delivery. Due to the number of variables involved in delivery, key holders must understand that exact delivery times can not be given.
c. Deliveries cancelled with less than 2 weeks notice are subject to a charge of £ 500. Deliveries cancelled with less than 24 hours notice, including orders which must be cancelled due to non-readiness of premises (as outlined in Section 6, below) or non-payment of final account balance, are subject to a £ 1,000 penalty.
d. Unless stipulated otherwise in the furniture proposal, furniture which requires assembly/installation will be assembled and installed free of charge at the time of delivery. However, any assembly/installation which can not be completed on this date due to non-readiness of premises (see Section 6 below) will become the responsibility of the client.
5. Storage Terms.
By paying the second instalment, the client instructs PSO to proceed with procuring the furniture and also agrees an estimated delivery date, approximately 6 weeks from the date of payment. Furniture will be stored free of charge for one month for all deliveries that have not left the UK. All deliveries that have left a storage fee applies. The storage fee is charged on a per unit (per apartment or per house) basis and is payable along with the final account balance on or before delivery. The fee is € 100 per month for 1- and 2-bedroom properties, and € 150 per month for 3- and 4-bedroom properties. This is a fixed monthly fee and is charged regardless of whether storage is for all or a portion of the month.
6. Readiness of Premises to Receive Delivery.
It is the client´s responsibility to ensure that the property is in fit state to receive delivery.
a. For newly purchased properties, deeds must be signed and habitation licenses granted before delivery. (Your lawyer should be able to keep you informed of when you can receive furnishings.)
b. Water and electric should be on. If electric is not on at time of installation, PSO may be unable to complete installation. (For instance, certain wall-mounted items, such as curtains, lights, some headboards and mirrors, will not be hung. If light from windows is insufficient, electric light may be required to assemble furniture, particularly during winter months when daylight hours are short and light is frequently dim.)
c. To protect furnishings, particularly soft furnishings such as sofas, rugs, and curtains, the premises should be clean and free from excess dust (particularly that due to construction work).
d. If the property is on the 2nd floor or above, then the elevator must be operational.
7. Cancellation of Order.
a. If the 2nd stage payment has not yet been made, then orders can be cancelled by written notice from the client. An administrative fee equal to the 30% first instalment paid by the client will be charged.
b. After the 2nd stage payment, PSO has already ordered the furniture items and entered into an agreement to purchase with the supplier. Therefore, refunds are not permitted. However, should the client wish to cancel, the client may do so by providing written notice.
I. Generally, an administrative fee of 30% of the order value will be charged. After deducting the administrative fee from the total amount paid by the client, the balance will remain as an account credit, which can be used for future purchases within 12 months.
ii. For customized or highly individualized furnishings (such as custom made curtains, bed covers, and other non-standard stock items) which we are unable to return, then the client maintains responsibility for purchasing the item, and no credit balance will be given.
8. Ownership.
The furniture remains the property of PSO Ltd until the final balance has been paid and the installation completed.
9. Superior Force.
PSO Ltd is not liable for any delays caused by an act of God, war, civil unrest, government order, fire, or any other matter over which PSO has no control.
